Purpose

The purpose of this Data Subject Rights document is to inform and clarify individuals' rights regarding their personal data, as established by the General Data Protection Law (LGPD). It highlights the rights of access, rectification, deletion, portability, objection, withdrawal of consent, and the right not to be subject to automated decisions. It also emphasizes the importance of balancing automation with the protection of individual rights and provides contact information so data subjects can exercise these rights or ask questions related to the protection of personal data.

The Right Not to Be Subject to Automated Decisions is one of the rights guaranteed to data subjects under data protection laws, such as the General Data Protection Law (LGPD) in Brazil and the General Data Protection Regulation (GDPR) in the European Union. This right refers to the data subject's ability to prevent significant decisions about them from being made exclusively by automated systems, such as algorithms or artificial intelligence, without human intervention.

In other words, the Right Not to Be Subject to Automated Decisions ensures that people have the right to be heard, to contest, and to receive an explanation about decisions that affect their interests, especially those that may have significant consequences in their lives, such as decisions regarding credit, employment, promotions, social benefits, or any other area where personal data is used to determine an outcome.

This right is important to ensure that the automation of processes does not harm the rights and interests of individuals, allowing them the opportunity for human intervention to contest or influence the decision. Organizations are generally required to inform data subjects when they make automated decisions that affect them and to allow them to request a review or human intervention, if necessary.

Therefore, the Right Not to Be Subject to Automated Decisions aims to balance the efficiency provided by automation with the protection of individual rights, ensuring that people have control over how their data is used in automated decision-making processes.
